JOB APPLICANTS’ PERSONAL DATA PROTECTION POLICY

TRIGANO JARDIN takes the respect for private life and the protection of personal data seriously.

We consequently commit to take adequate measures to ensure the protection, the confidentiality and the security of your personal data and to process and use such data in accordance with regulations in force and specifically with the April 27th, 2016 European Regulation 2016/679 (GDPR) and the January 6th, 1978 law n°78-17 called “Computer Technology and Freedoms Act” (Loi Informatique et Libertés).

  1. Scope of this policy

This policy applies to all personal data processing carried out by TRIGANO JARDIN as a Controller within the meaning of applicable regulation regarding unsolicited job applicants or applicants responding to existing job offers.

  1. Data collected, purpose and legal basis
  • Collected data:
  • Identification and contact information (last name, first name, email, address, phone number),
  • Résumé, educational and professional background,
  • Cover letter,
  • Interests,
  • Any information we may collect during interviews related to the recruiting process,
  • Any information that you freely provide within the framework of the recruiting process.

This data is either collected directly from you or is provided by third parties, this including recruiting service providers or references you gave us during the recruiting process.

  • Purpose of the collection:

The collected data is processed for the purpose of:

  • Studying your application in order to allow us to decide if it corresponds to the position for which you have applied or any other position within TRIGANO JARDIN,
  • More broadly to manage the recruiting process and to contact you to set up meetings,
  • To contact you in the future should any opportunity that would suit you present itself within TRIGANO JARDIN, provided there was no opposition on your part.  
  • Legal basis:

This processing is in part necessary for the execution of pre-contractual steps, that is to say to analyze your application and to determine whether we wish to enter into an employment contract with you, and in part necessary for the safeguarding of the company’s legitimate interest when we keep your file to contact you in the event of an opportunity that might suit you. This processing therefore contributes to the TRIGANO JARDIN’s recruitment process’ optimization and benefits TRIGANO JARDIN as well as the candidates.

  1. Duration of data storage

We hold your information as long as necessary for the completion of the purposes for which we have collected and processed it (see 2).

Should your application be selected and you join TRIGANO JARDIN, your data shall be held for the duration of your presence within TRIGANO JARDIN (duration of the employment contract) and for the applicable prescription period, following which it shall be destroyed (5 years after your departure).

Should your application be rejected, your information shall be kept for the duration of 6 months after which it shall be destroyed.

  1. Access and communication of your data

Your data shall only be accessible inside the company by the services that need access to said data for the purposes mentioned under 2: human resources and the department with which the position for which you have applied is linked.

Your personal data may also be shared with:

  • Public authorities when required by law,
  • French and foreign authorities when linked to legal or administrative proceedings of any nature or to law application measures requested by competent authorities.

We may also be led to collaborate with service providers acting as processors to perform services linked with the data processing we carry out. These processors provide services including hosting, data processing, data base management or computer maintenance. These service providers only act following TRIGANO JARDIN’s instructions and shall be held to the same obligations of security and confidentiality as TRIGANO JARDIN.

  1. Personal data protection and security

TRIGANO JARDIN commits to take all reasonable and appropriate organizational and technical measures to prevent any disclosure, use, alteration, loss or destruction of the personal data a candidate has provided.

  1. Your Rights

Pursuant to applicable regulation, you have the following rights regarding personal data:

  • Right to information,
  • Right to access,
  • Right to rectify,
  • Right to erase,
  • Right to restrict the processing,
  • Right to oppose the processing of your data when the processing is based on TRIGANO JARDIN’s legitimate interest (see 2),
  • Right to data portability,
  • Right to provide us with specific directives regarding the fate of your personal data after your death,
  • Right to file a claim with the CNIL.
